Roberts: Delaware court ruling major victory for the Bahamian people

The ruling by Judge Kevin Carey in a Delaware bankruptcy court today essentially backing the judgment of Justice Ian Winder of the Bahamas Supreme Court that the matter of Baha Mar must be adjudicated in the Jurisdiction of The Bahamas is a major victory for Bahamian sovereignty and by extension, the Bahamian people.

The PLP welcomes this legal ruling as moving the matter of Baha Mar one step closer to resolution.

Judge Carey ruled that Baha Mar’s creditors had “a legitimate expectation” that any insolvency proceedings involving the mega resort should take place in The Bahamas. The PLP agrees.

The government of The Bahamas has asserted from the beginning of the Delaware proceedings back in June of this year that it was a matter of national sovereignty and that its singular objective in this bankruptcy matter was the expeditious completion and opening of Baha Mar in the national interest. The PLP agrees with the government.

To the 2,500 Bahamian employees of Baha Mar and the scores of Bahamian contractors and service providers, the actions taken by the Bahamas government were intended to protect your employment and investment regardless of what ANYBODY said to the contrary. The government will continue to serve your best interests.

Regardless of what the critics, the naysayers and the doomsday preachers have said - on the major of defining policy issues facing this country, this PLP government stood on the side of the welfare of the Bahamian people, placing the PLP government on the right side of history. 

Dr. Minnis and the FNM were wrong on Baha Mar. They backed the Delaware bankruptcy Court petition and were proven wrong. They were critical and scoffed at the government’s petition in the Bahamas Supreme Court to protect the national sovereign, the employment, and the investment of thousands of Bahamians; they were proven wrong. The FNM criticized the government’s decision to pay the Bahamian workers employed at Baha Mar.

THEY FAILED AT EVERY TURN TO STAND UP FOR BAHAMIANS

If Bahamians had misgivings and were unsure about the leadership capabilities and policy acumen of Dr. Minnis, his latest blunder and incredible display of poor judgment must convinced all and sundry that Dr. Minnis is no leader. He fumbled the ball on a major policy matter with widespread implications for our economy and public finances.

He was wrong on fiscal reform; he was wrong on gaming reform; and he was wrong on the best way forward on Baha Mar. He is incapable to comprehending what is in the best interest of the Bahamian people. One needs to only examine his track record; he was on the wrong side of history on practically every major policy issue confronting this country that required leadership, wisdom and a measure of political acumen to solve.  

This is the third occasion that I have had the pleasure of inviting Dr. Minnis and his “Not ready for Primetime” FNM players to eat crow and to do so liberally.

The incorrigible and unpatriotic Carl Bethel is invited to consume a double portion. He had the audacity to ridicule the Bahamas judiciary, the independent and equal branch of government constituted to protect the rights of Bahamians for its ruling in the interest of Bahamians. This was inexcusable.      

Had Dr. Minnis been in a position of executive leadership under these challenging times, given the decisions he has made thus far, our once fair Commonwealth would have crashed and burned long ago.

We encourage the Bahamas government to remain focused as they continue to govern in the best interest of all Bahamians.
