Grand Bahama, The BahamasSmith Point Limited, Callenders and Co., and Bahamian Outdoor Adventure Tours Limited filed an application for leave to bring judicial review proceedings against the Comptroller of Customs on February 24th, 2011 on the grounds that there is no lawful basis on which Customs can impose a requirement that Grand Bahama Port Authority licensees should have to obtain a letter of good standing from the National Insurance Board in order to receive their letter authorizing the purchase of goods in bond over the counter.

(1) Smith Point Limited, Sanctuary Bay, Grand Bahama, a builder investor and licensee of the Grand Bahama Port Authority (“ GBPA”);

(2) Callenders & Co., (“ Callenders”) Island House, The Mall, Freeport, Grand Bahama, attorneys and licensee of the GBPA;

(3) Bahamian Outdoor Adventure Tours Limited, (“ BOATours”) Island House, The Mall, Freeport Grand Bahama, tour operator and licensee of the GBPA.

Judgment, Order, Decision or other proceeding in respect of which relief is sought


The decision of the Comptroller of H.M. Customs to demand that Licensees of The Grand Bahama Port Authority Limited are required to obtain a letter of good standing from the National Insurance Board (“ NIB”) as a condition of Customs issuing the Licensee with an “over the counter” letter purporting to authorize such Licensee to purchase goods in bond over the counter from other GBPA Licensees (“ the Decision”)
