The Truth Behind Gambling in The Bahamas

I listened to a talk show yesterday and the discussion was on gambling in the Bahamas: (casinos/casino resorts, numbers etc).

I paid full attention and I said I will do a little investigation.

As some of you know by now, I admitted that I used to gamble (via raffle tickets for the Church, scratch and win giveaways, playing over and under (craps) and/or throwing quarters in the cup at the carnival, dropping my name in sweepstakes at fast food restaurants, gas stations, furniture stores etc along with purchasing shares in the local or foreign stock markets which are all forms of Gambling (Games of Chance).

Education is the key to success my fellow Bahamian people:

With that said, for my fellow Bahamians who may not be familiar of the official meaning of gambling, here goes:

1. An act or undertaking of uncertain outcome; a risk: I took a gamble that stock prices would rise.

2. To play at any game of chance for money or other stakes.

3. To stake or risk money, or anything of value, on the outcome of something involving chance: to gamble on a toss of the dice.

4. To lose or squander by betting (usually fol. by away): He gambled all his hard-earned money away in one night.

5. To wager or risk (money or something else of value): to gamble one's freedom.

6. To take a chance on; venture; risk: I'm gambling that our new store will be a success.

7. Any matter or thing involving risk or hazardous uncertainty.

8. A venture in a game of chance for stakes, esp. for high stakes.

Let’s take a look at one of the synonyms of Gambling:


RAFFLE TICKETS:

1. A form of lottery in which a number of persons buy one or more chances to win a prize.

2. To dispose of by a raffle (often fol. by off): to raffle off a watch.

3. To take part in a raffle.


Synonyms of raffle tickets are as follows:

bet, betting, bingo, disposition, draw, drawing, flier, gambling, game of chance, gaming, long odds, lots*, numbers, numbers game, pool, random shot, speculation, stake, sweep, sweepstake, tossup, wager, wagering.

Don't forget Bingo:

1. a form of lotto in which balls or slips, each with a number and one of the letters B, I, N, G, or O, are drawn at random and players cover the corresponding numbers printed on their cards, the winner being the first to cover five numbers in any row or diagonal or, sometimes, all numbers on the card.

2. a game of chance in which each player has one or more cards printed with differently numbered squares on which to place markers when the respective numbers are drawn and announced by a caller. The first player to mark a complete row of numbers is the winner.
interj. Used to express the sudden completion of an event, occurrence of an idea, or confirmation of a guess.

Synonyms of bingo are as follows:

bingo, bridge, canasta, craps, crazy eights, gambling game, gin, gin rummy, lottery, lotto, penny ante, pinochle, poker, roulette, twenty-one, wheel of fortune.

Education is the key to success my fellow Bahamian People.

After completing a thorough investigation, I was able to do some deep thinking, and I am going to share with you what I discovered after speaking with two lawyers (one of them is well known as the top lawyer in this country) along with a few of my older associates.

After I was advised to read the entire lottery and gaming act, one of the lawyers told me that:

Firstly, the reason why Flower*, Islan* Luc*, Re* Ho*, Bow*, Fantas* etc can legally continue to operate their internet cafes in the Bahamas is because there is absolutely nothing stating that internet gaming is illegal in the lottery & gaming act or in the constitution of the Bahamas.

Secondly, internet cafe business licenses are legal and obviously business licenses are purchased from the Bahamian government (which are on display just like in every other business that displays their business license), along with the fact that the internet cafes in the Bahamas pay income tax.

(Yes we all do pay income tax as your business license fee is determined based on how much income your business made during the previous year).

The owners of the internet cafes pay BEC for electricity, Water and Sewage for obvious reasons, BTC (Batelco) for phone service and either BTC or any of the other local internet providers for internet services with the strong probability of V.O.I.P (Voice Over Internet Protocol/Telephony Services) included, local Security/Armored Truck Companies, Construction Companies, Landscaping Companies and the list of local businesses who benefit from the internet cafes goes on and on including national insurance contributions for their staff along with depositing their monies into the various local banks and trust me, their deposits are more than 5 thousand dollars, but yet they do not have to fill out a declaration form to show where their monies came from since their money is from a legal business. Also, loans and salary deductions are provided by the local banks for all of the staff of the internet cafes.

Thirdly, he stated that no Bahamian or non-Bahamian can be arrested (and if so, it is illegal) but again, no Bahamian or non-Bahamian can be arrested for going into an internet cafe or playing on a gaming website inside an internet café because again, that business has a legal business license along with the fact that there is no law preventing any nationality from accessing any internet gaming website at any location in the Bahamas.

In addition, the Bahamian government has no control over websites based in New York, Chicago, Miami or anywhere else in the world.

The only thing the Bahamian government can do is to block the website from being accessible in the Bahamas (which I don’t think they can do.)

Fourthly, he stated that to prove his point even further that the internet cafe business in the Bahamas is in fact a legal business, the fact that one of the present internet cafe owners is presently constructing their multi storey internet cafe headquarters with a legal permit # approved by the MOW (the former Hote* Europ*), proves again that what he stated is 100% fact.

(The internet cafe headquarters which is presently being constructed downtown located two buildings from the Police Station, has their permit # 111398 displayed on their sign.)

Lastly, he stated that the Bahamian government cannot ban certain websites (gaming websites in this case) because:

a) There is no law to do so.

b) That would be un-democratic as it will infringe on the rights of the Bahamian people to access the internet like how communist countries do. (E.g. Iran, China, Cuba, North Korea etc). Not only that, if only a select few gaming websites are accessible to certain businesses in the Bahamas and not accessible to others in the Bahamas, that would not be democratic.

c) If the Bahamian government were to ban internet gaming (which is impossible but if they still attempted to) what will happen to the sports books that operate in the casinos/casino resorts?

After speaking to a much older person who informed me that he is a Christian, he stated that the decision behind Si* Staffor* Sand*, Si* Rowlan* Symonett*, Si* Lynde* Pindlin*, Si* Pau* Adderle*, Si* Arthu* Hann* and the rest of the officials back then and present who all decided directly, who either created or who accepted and did nothing to change the constitution of the Bahamas and/or the lottery & gaming act from stating that Bahamians should not be allowed to play in the casino/casino resorts had nothing to do with Religion or Christianity, but rather pressure from racism and discrimination from the non-Bahamian casino/casino resort owners back then.

I asked him to further explain.

He explained that the non-Bahamian owners of the casinos/casino resorts back then made it clear that they did not want any Bahamians (and off course the majority of Bahamians were black) but again, they did not want any Bahamians gambling in the casinos/casino resorts to mix with the tourists (who were mostly not black) because of the fact that the non-Bahamian casino/casino resort owners felt that Bahamians were uncivilized savages that are unable to control themselves.

He also stated that in the eyes of the non-Bahamian casino/casino resort owners, Bahamians were only civilized enough for the menial lower paying jobs (e.g. maid, security guards, cooks, bell boys, garbage boys etc), which is the only reason why a Bahamian would be allowed in the casinos/casino resorts (literally through the back door) at that time.

The bottom line is they (the non-Bahamian casino/casino resort owners) made it quite clear to the powers that be (the Bahamian government) that they did not want any Bahamians in their casinos/casino resorts around the non-Bahamians, which is the dominant reason why this form of racism and discrimination still lives on today in the Bahamas.

More shockingly, he stated that the Church and the Bahamian government at that time had to come up with a logical explanation as to why Bahamians cannot play in the casinos/casino resorts in the Bahamas.

He indicated that their explanation had to be a very well thought off, scapegoat reason for the rest of the Bahamian people to believe and accept as the supposed educated leaders who were all in a compromising monetary and authoritative position, felt that the rest of the Bahamian people were poor, uneducated and could easily be persuaded and brainwashed.

The excuse he stated that the Church leaders and the Bahamian government eventually came up with for Bahamians not being able to gamble in the casinos/casino resorts is indicated below:

The reason why Bahamians cannot gamble in the casinos/casino resorts is because the Bahamian men will not take care of the families and their home and they will squander all of their money and destroy their families, using the now closed Montag* Par* Rac* Cours* aka Hobb* Hors* Hal* Rac* Trac*as a scapegoat excuse, in which he made an even more shocking statement regarding the role that the Hobb* Hors* Hal* Rac* Trac* played in which a lot of people never realized.

He stated that it was intentional for Bahamians to be allowed gamble at the Hobb* Hors* Hal* Rac* Trac* so that some of the minority of Bahamians who did in fact gamble there would do exactly what and act exactly how the non-Bahamian casino/casino resort owners expected them to, which in turn was ultimately used as the perfect excuse by the non-Bahamian casino/casino resort owners as to why all Bahamians should not be allowed to gamble in their casinos/casino resorts because of the actions of a few Bahamians at a small scale race track.

Not only that, he stated that the primary reason why the Hobb* Hors* Hal* Rac* Trac* was closed down for good (despite the fact that it was supposed to be relocated on Gladstone Road) primarily had nothing to do with the Christian Council as so many Bahamians believed.

He stated that it all boiled down to making the non-Bahamian owners of the casinos/casino resorts happy and willing to do more business in the Bahamas along with the Bahamian government deciding which one would make them more money (a small scale horse race track or a multi-million/billion dollar casino/casino resort).

He added that the plan of the Bahamian government was to recycle the previous gaming license used by the Hobb* Hors* Hal* Rac* Trac* to open the Playbo* Casin* owned and operated by Playbo* Bahama* Limite* which opened for business in the Ambassado* Beac* Hote* either on March or April 1978.

The gaming license previously used by the Hobb* Hors* Hal* Rac* Trac* was recycled due to the fact that the owners of the casinos/casino resorts did not want any further competition to exist in the Bahamas and in order for the Bahamian government to satisfy the non-Bahamian owners of the casinos/casino resorts, the Bahamian government stated that they will not grant anymore certificates of exemption for new gaming licenses.

As a result, the Bahamian government had no choice but to close the Hobb* Hors* Hal* Rac* Trac* in order to keep their promise or else the non-Bahamian casino/casino resort owners would be unhappy and threatened to discontinue their services in the Bahamas which would have heavily negatively affected the revenue made by the Bahamian government.

On the other hand, he further explained that the Bahamian government used the following excuse to silence any noise that would have come from the religious community. The Bahamian government made a promise that they had no plans on keeping the Hobb* Hors* Hal* Rac* Track open along with stating that it will never reopen. The Bahamian government also stated that there would be no new certificates of exemption to allow any new casino/casino resort operators in the Bahamas, (which was true).

However, the Bahamian government falsely gave the impression that the gaming license used to operate the Hobb* Hors* Hal* Rac* Trac* would be rid off for good.

The Bahamian government never informed the religious community (or the public at large) that they planned on reusing the gaming license used by the Hobb* Hors* Hal* Rac* Trac* to open the Playbo* Casin* because the Bahamian government knew that this would cause the religious community to become upset and more than likely cause them money and even worse, votes and power.

In other words, the Bahamian government told the religious community half the truth but not the whole truth.

I then asked him these questions among others:

What about women, don’t women gamble too?

Is it only the men who will squander their money?

There are women also who don’t take care of their families as well, maybe not as much as men but it happens.

Also, this commonly used "not taking care of their families" excuse has no merit with Bahamians who are single without kids and/or persons who are only responsible to them self. (e.g. sterile persons/couples, divorced persons, widows/widowers, retirees) or any other Bahamian who has no family members to be responsible for.

How can the "not take care of their families" excuse apply to these Bahamians as again, there are many Bahamians who have no family to take care off and fit the above description?

Most importantly, how can the supposed powers that be or any average Bahamian/non-Bahamian prejudge another mans actions unless their name is Miss Cleo, and we all know how that turned out?

In addition, how can a small minority of Bahamians who's examples of poor judgment in the way they managed their money at a small scale horse race track be used as an excuse to prevent all Bahamians from playing in a casino/casino resort in the Bahamas as all Bahamians and tourists regardless of race are equal?

I also stated the fact that since all Bahamians finally achieved the right to gamble in the casinos/casino resorts for almost two years after Majority Rule Day (between 1967-1969) along with the fact that the Hobb* Hors* Hal* Rac* closed down for good in 1978, why is it that every single person who agrees with discrimination against Bahamians state that the primary reason why Bahamians are automatically disqualified from playing in the casino was because of the Hobb* Hors* Hal* Rac* Trac* even though Bahamians were barred from casino gambling 9 years prior (1969)?

In the event that you are unaware of a small recent piece of Bahamian history when it comes to casino/casino resort gaming in the Bahamas, the first casino to ever open its doors in the Bahamas was the Bahamia* Clu* which opened in the 1920's by a man named m* Mackenzi* who happened to be an American from Rhode Island and another American named C.F. Ree*. After it was obvious that the Bahamia* Clu* was such a successful business, a few years later after it opened, m* Shirle* Oake* Butle* wanted to buy the Bahamia* Clu* from m* Mackenzi* and m* C.F. Ree* to donate a large amount of her winnings to charity. Consequently, a very powerful and influential businessman/lawyer/politician named Si* Staffor* Sand* did everything in his power to not make that a reality because of the fact that m* Shirle* Oake* Butle* had no intention on retaining the legal services of Si* Staffor* Sand*. As a result of the key role that Si* Staffor* Sand* played, the Bahamia* Clu* was eventually sold to the Mar* Carte* Pain* Compan* aka Paradis* Enterpris* aka Resort* Internationa* who off course retained the legal services of Si* Staffor* Sand*.

Now when it comes to casinos/casino resorts as we now know it in the 21st century, the persons/companies who were directly responsible for that include but are not limited to:

The Mont* Carl*, E* Casin*, The Ca* Ca* Casin*, The Princes* Casin*, m* Wallac* Grove* (a convicted stock swindler), m* Loui* Chesle* (a major Florida land developer and compulsive gambler), m* Jame* Crosb* and m* Jac* Davi* (The Mar* Carte* Pain* Compan* aka Paradis* Enterpris* aka Resort* Internationa*), and one of the biggest players of all, a man by the name of m* Meye* Lansk* (the boss), m* Mik* Mclane* (a helicopter pilot and the right hand man of m* Meye* Lansk*) m* Din* Cellin* and m* Eddi* Cellin* (the managers who worked closely under m* Lansk*) and the rest of m* Meye* Lansk*’s crew who came to the Bahamas in the early 1960’s from Cuba after President Batist* lost to President Castr* in the 1959 Cuban elections which resulted in President Castr* shutting down all of the Cuban casinos/casino resorts which were brought to Cuba by President Batist* and ran by m* Meye* Lansk* and crew prior to the 1959 Cuban elections.

(Despite it all, even though he was an ex-convict with a very long rap sheet who the FBI desperately wanted to put away for good but could not do so since he operated from the Bahamas, the fact is whether we want to admit it or not, m* Meye* Lansk* came to the Bahamas and was directly responsible for many Churches, schools, businesses and other structures that were built by him from his gambling proceeds).

What I would like to know is how could any Bahamian (especially those who work directly or indirectly in the gaming industry of the Bahamas) say that if Bahamians had 100% access in the Gaming Industry of the Bahamas, all Bahamians will not take care of their families or attempt to use that as a logical enough reason to not allow all Bahamians to play in the casinos/casino resorts as they are the very same persons who promote and contribute to the tourists coming from their countries to do the very same thing they don’t want Bahamians to do?

What about the tourists that come here to gamble at Atlanti*,Crysta* Palac*, Fou* Seaso*,Bimin* Ba* Resor* an* Casin*, Isl* O* Capr* Casin* or any other casino/casino resort?

When the tourists come here and lose all of their money in the local casinos/casino resorts, what about their families back home?

(I can guarantee you that any Bahamian who justifies discrimination against them self who is still directly promoting the message of the UBP is living proof of how they were and are still victims of being brainwashed for the purpose of racism and stupidity.)

His response to all of my questions was simple.

He stated that back then and presently, the Bahamian government along with the rest of the Bahamians who work directly or indirectly for the casinos/casino resorts could care less about the families of the tourists back home who lose their monies here in the casinos/casino resorts but rather, the Bahamian government and the rest of the Bahamians continue to encourage the tourist to lose all their monies in the casinos/casino resorts, as all of the Bahamians who work directly or indirectly for the casinos/casino resorts support gambling 100% because if they did not, they would not contribute to the success of a company that provides gambling which is obvious as these persons only care about filling up their pockets no matter what their role is in the casino/casino resorts whether it be:

(CASINO DEALERS, SHUTTLE BUS/SUV/LIMO DRIVERS, SECURITY GUARDS, GAMING BOARD EMPLOYEES, PIT BOSSES, COOKS, PIT CLERKS, FRONT DESK AGENTS, POOL STAFF, WAITOR OR WAITRESS, BELL BOYS, MAIDS, SPACE CLEANERS, SLOT MACHINE ATTENDANTS/TECHNICIANS, DISH WASHERS, CASINO CREDIT UNION EMPLOYEES, LANDSCAPERS, PAINTERS, SPORTS BOOK EMPLOYEES, GARBAGE BOYS, CASINO SECURITY, ACCOUNTING, among others etc) as they are all contributing to the bottom line of the success of the casino/casino resort and more importantly, the gaming industry of the Bahamas.

Each role (regardless of whether or not you directly work in the casino department of a casino/casino resort) is vital as you are still contributing to the bottom line regardless of how minor you think your role may be.

By the way, for those who don’t want to accept that or do not understand that, here is a simple explanation for you:

A human has body parts/organs.

Every part/organ in the human body must play their role and if not, what would happen to the human body?

The human would either become sick or even worse; the human would die if the body parts/organs don’t play their role no matter how big or small the role of each body part/organ may be because at the end of it all, each role is very much important to the life and health of the human.

I then explained to him that how could persons who claim that they are Christians:

Firstly, work in places like the Gamin* Boar*, the Casin* Credi* Unio*, Atlanti*, Crysta* Palac* or any casino/casino resort or other businesses that are directly or indirectly affiliated with gambling since Christians are so outspoken and opposed to all forms of Gambling.

Secondly, how could the persons who claim to be Christians that are opposed to gambling in the Bahamas work at those locations mentioned above agreeing with a "DONT CARE FOR THE TOURISTS FAMILIES BACK HOME AFTER THEY LOSE ALL OF THEIR MONEY HERE IN OUR LOCAL NON-BAHAMIAN OWNED CASINO RESORTS AND GO BACK HOME UNABLE TO TAKE CARE OF THEIR FAMILIES” kind of thinking.

Bottom line is as I stated before on other threads, I am totally against racism and discrimination. I am not a gambler but honestly, you cannot force people to believe in what you believe in and understand that everyone (Bahamian and tourist) must equally legally have the right to make their own decisions on how they as adults want to spend their own money within the context of the law.

In other words, as long as it’s not a crime for all, everyone should have the same right as others in a democracy.

Now I will also add that legal or not, I feel that everyone has to answer for themselves when that certain time comes but any and every human being should equally be allowed to play in any casino/casino resort in the Bahamas if they wish.

On the other hand, I feel that the job of any person who claims to be a true Christian that is opposed to all forms of gambling is to not facilitate or promote gambling by working at those very same places where gambling, alcohol, smoking or any other location that does not glorify God but rather, go to those very locations to encourage lost persons to not promote, work, or engage in any of the above mentioned, and then let the lost person make their own decision.

However, if it is legal for a certain set of people to do something in the Bahamas and illegal for another set of people to do something in the Bahamas because of their nationality, (regardless of whatever the activity is we may feel that is not moral or in Gods eyes), since its quite obvious that racism and discrimination are being used in regards to Bahamians not being able to play in the casinos/casino resorts in the Bahamas, I now realize that unless gambling is outlawed for all Bahamians and tourists straight across the board or vice versa in the Bahamas, gambling cannot be compared to illegal drugs, illegal guns, prostitution, murder, rape etc, because those activities/crimes are illegal in the Bahamas for all nationalities and not illegal for Bahamians only.

I guess what I am saying may come as a shock to some but the reason why I am against the present law is because its obvious that racism and discrimination are being used and its unbelievable that the excuse given for it to last this long is still being accepted by some Bahamians (in which Si* Rowlan* Symonett*, Si* Staffor* Sand* and others) legacy still lives on strong today in the Bahamas through them, because again, its so unbelievable that some Bahamians actually think that the excuses given by the supposed leaders of this country back in the 60's and present, is a logical enough reason for those select Bahamians to accept discrimination against them self in their own country.

I know one thing though, how in the world can the Bahamian government tell me that because of my Bahamian nationality, if I wanted to play in a casino/casino resort in the Bahamas, I cannot do so because I am a Bahamian?

That is totally ridiculous, nothing to do with Religion, Christianity or anything else, that is unacceptable and a slap in my face, your face and the rest of the faces of the Bahamian people as we are all being treated like second class citizens.

Now for those of you who may not know:

Protection of Fundamental Rights and Freedoms of the Individual

CHAPTER III PROTECTION OF FUNDAMENTAL RIGHTS AND FREEDOMS OF THE INDIVIDUAL

15. Fundamental rights and freedoms of the individual.

26. Protection from discrimination on the grounds of race, etc.

1. Subject to the provision of paragraph (4), (5) and (9) of this Article no law shall make any provision which is discriminatory either of itself or in its effect.

2. Subject to the provisions of paragraphs (6), (9) and (10) of this Article, no person shall be treated in a discriminatory manner by any person acting by virtue of any written law or in the performance of the function of any public office or any public authority.

3. In this Article, the expression "discriminatory" means affording different treatment to different person attributable wholly or mainly to their respective descriptions by race, place of origin political opinions colour or creed whereby person of one such description are subjected to disabilities or restrictions to which person of another such description are not made subject or are accorded privileges or advantages which are not accorded to persons of another such description.

Then here is where the contradiction comes in:

4. Paragraph (1) of this Article shall not apply to any law so far as that law makes provision-

for authorizing the granting of licenses or certificates permitting the conduct of a lottery, the keeping of a gaming house or the carrying on of gambling in any of its forms subject to conditions which impose upon persons who are citizens of The Bahamas disabilities or restriction to which other persons are not made subject.

Along with another contradiction:

If you live in the Bahamas or possess/require a permit to engage in gainful occupation to make money in the Bahamas under the provisions of any statute regulating immigration, is the holder of a permanent residence certificate granted under any statute regulating immigration, is ordinarily a resident in the Bahamas, is engaged in any business or profession, is employed for gain, is in the employment of the government of the Bahamas, under 18 along with every tourist who is married to anyone fitting in the descriptions mentioned above, you cannot play in any casino/casino resort in the Bahamas.

My question is what is the purpose of The Protection of Fundamental Rights and Freedoms of the Individual if it is doing the exact opposite of what it was intended to do?

With that said, what about m* So* Kerzne*, m* Sarki* Izmirlia* or any of the other owners of the casino resorts in the Bahamas.

Are they allowed to play in their own casino/casino resorts in the Bahamas or any of their competitor’s casinos/casino resorts in the Bahamas since they (the owners of the casino's/casino resort's are obviously engaged in a business/profession in the Bahamas as the law states?

What about the fact that if m* So* Kerzne*, m* Sarki* Izmirilia* or any other casino/casino resort owner in the Bahamas wanted to marry a Bahamian?

Would they still be allowed to play in their own casino/casino resort or any other casino/casino resort in the Bahamas since they chose to marry a Bahamian?

You mean to tell me that not only Bahamians but the foreign owners of the casinos/casino resorts in the Bahamas are also being discriminated against because of the laws in the Bahamas?

Does this mean that the owners of the casinos/casino resorts are being prevented by law from marrying the Bahamian person they love because of the fact that if they do marry a Bahamian, the lottery and gaming act and the constitution of the Bahamas would automatically disqualify them from playing in every casino/casino resort in the Bahamas?

Come on people, even the owners of the casino/casino resorts are being discriminated against when it comes to them having the right to marry a Bahamian and still be able to freely play in any casino/casino resort in the Bahamas if they wish. Not only that, this form of discrimination does not only apply to the owners of the casinos/casino resorts, this also applies to every tourist who either recently or over the years, visited and played in the local casinos/casino resorts who fell in love with a Bahamian and since they eventually married the Bahamian they love, they automatically forfeit all of their rights to play in any casino/casino resort in the Bahamas.

I am against discrimination whether it is towards me (a Bahamian), every other Bahamian and/or every other tourist and it's unbelievable that even the non-Bahamian owners of the casinos/casino resorts and the tourists are being discriminated against in the Bahamas and that is also wrong.

Anyway, is there anyone (especially my learned brothers and sisters in the legal profession) who has any other input on the above topic or answers to some of the questions I asked and most importantly, why this is the case in the Bahamas?

I guess to sum it up, we all have the late Si* Rowlan* Symonett*, Si* Staffor* Sand* (and the rest of the supposed leaders or persons who had the ability to correct this wrong) to thank for the way the present gaming laws are in the Bahamas, as everyone one of their successors continue to carry on the legacy of the UBP from back then to now when it comes to gaming in the Bahamas as we Bahamians are all still victims of the policies of Si* Rowlan* Symonett* and Si* Staffor* Sand*, (the very same men whose faces are/were on our Bahamian currency.)

Again, gambling is not illegal in the Bahamas so the question of whether or not gambling should be legalized in the Bahamas is puerile.

We do not have to legalize gambling in the Bahamas or ask the question over and over if we should legalize gambling in the Bahamas because gambling has been legal in the Bahamas since the 1920's.

We have casinos/casino resorts, a gaming board, a casino credit union and other obvious examples that gambling (the gaming industry of the Bahamas) is presently legal in the Bahamas.

In addition, for all of you who may not know, below are just a few of the various forms of gambling (Games of Chance) which are presently legal in the Bahamas for all Bahamians and tourists of all ages (with one exception when it comes to craps at the carnival) to again legally participate in :

Now on the other hand, the only form gaming in the Bahamas that is 100% off limits to all Bahamian adults, all Bahamian children and all tourists that are married to Bahamians is casino gaming (gambling in the casino/casino resort) which is only available to tourists 18 and over who are not married to Bahamians.

Oh, one minor thing I would like to point out before I conclude.

I would like to let you know how the father of this nation "Si* Lnde* Pindlin*" played a key role in the way the gaming laws presently are when it comes to Bahamians being discriminated against in their own country.

Shortly after majority rule day, Si* Lynde* Pindlin* changed his mind about getting rid of the casinos/casino resorts in the Bahamas and instead, he allowed the casinos/casino resorts to continue operating in the Bahamas which were initially brought to the Bahamas in the early 60's by the U.B.P. (Si* Staffor* Sand*, Si* Rolan* Symonett* and crew) and the previously mentioned internationally known ex-convict mob boss named m* Meye* Lansk*, his right hand ex-convict associate m* Mik* Mclane* among others of the same character (fyi, m* Mik* Mclane* also happens to be the very same man who was responsible for Si* Lynde* Pindlin* helicopter travel around the Bahamas during his election campaign in 1966/67), along with Si* Lynde* Pindlin* retaining the services of the American public relations firm "Hil* & Knowlto*" to promote his message of Bahamian casino gambling around the world for tourists to see and to come and participate in (off course this excluded Bahamians as you will see the full story why shortly.)

(FYI, Hil* & Knowlto* was the same public relations firm who was in the right hand pocket of Si* Staffor* Sand* (the arch enemy of Si* Lynde* Pindlin*) a few days before being shockingly retained by Si* Lynde* Pindlin*.)

During this time of equality that Bahamians were finally enjoying after a long struggle for freedom and equality on Majority Rule Day in 1967, their short lived privileges to exercise their right to play in a casino/casino resort in the Bahamas was all of a sudden stopped because in 1969, the unthinkable occurred.

Si* Lynde* Pindlin* and crew visited the British government in 1969 to supposedly fine tune the Bahamian constitution for numerous reasons in which one reason in particular truly stood out to be the most shocking of all, not only to the entire British commonwealth, but to the rest of the world.

Apart from the fact that Si* Lynde* Pindlin* wanted to amend the constitution in order for him to have complete control over the Police Force, most shockingly:

Si* Lynde* Pindlin* went to the British government with the intention of preventing all Bahamians from being able to play in any casino/casino resort in the Bahamas but rather, only allow that right to tourists that are not married to Bahamians.

The entire British government that was present at that meeting of epic proportions (especially the colonial secretary) was in tremendous state of confusion.

They all wanted to know if the prime minister of the Bahamas "Si* Lynde* Pindlin*" had lost his mind to request discriminating against his own people yet alone, British citizens (which they all were at that meeting) as this meeting occurred in 1969 (before the supposed independence of the Bahamas from the British which occurred a few years later.)

The British government repeatedly asked Si* Lynde* Pindlin* if he realized what in the world he was doing because again, they thought Si* Lynde* Pindlin* had lost his mind because of the fact that he was promoting discrimination (not only against the Bahamian people he was supposed to be representing), but again, they could not believe that Si* Lynde* Pindlin* was promoting discrimination against himself.

Do you know what the most interesting part was?

The British government rejected his highly unexpected and shocking request and told him that he cannot be serious to request discriminating against British citizens (which all Bahamians were at that time in 1969) because the members of the British government were obviously British citizens as well, along with the fact that the Bahamian constitution clearly stated that no British/Bahamian citizen could be discriminated against for any reason in the Bahamas.

After the British government officials conducted further discussions in trying to figure why Si* Lynde* Pindlin* would request to discriminate against himself and his own people, they then informed Si* Lynde* Pindlin* that since he is in fact the prime minister of the Bahamas along with the fact that since he was so determined to discriminate against his own people, he was advised by them (the British government) to start over and to get a team of lawyers to try to get around the fact that no person should be discriminated against (including himself) in his own country, and to come back when he does find away around it.

(By the way, the British government still gave Si* Lynde* Pindlin* the benefit of the doubt because of the fact that they were not expecting him to carry out his initial request of taking away a big portion of equality which his people had fought so hard for when Majority Rule Day occurred because they truly thought that Si* Lynde* Pindlin* was not in his right mind at the time of his request).

Later and to the shocking surprise of the British Government, Si* Lynde* Pindlin* did in fact come back with his very same request written in new form with the assistance of a few local lawyers with the very same message of discrimination against his own Bahamian citizens, (which today proves how determined he was to discriminate against his own people) as the law preventing Bahamians from playing in a casino/casino resort was eventually passed by the British government to their amusement because again, the British Government was so confused with the fact that Si* Lynde* Pindlin* was throwing away the message that he preached when Bahamians fought to obtain equality on Majority Rule Day.

As we can all see to this day, Si* Lynde* Pindlin* was successful in creating one of the most contradictory constitutions in a supposed democratic country to ever in exist in the world.

Proof of that is the fact that this contradictory law still exists today in the 21st century.

Now here is a classic example of how money can compromise one to promote discrimination against him, myself, and you whomever you are reading this, his family and his friends, my family and my friends, your family and your friends and every other Bahamian as it is so obvious that money and hate are behind his comments below.

Why on May 6th 2009 would the president of the Bahamas hotel association (who allegedly also happens to be a Bahamian which is even more shocking) announce to the entire world (via the media/internet) state that he and his association supports a national lottery along with agreeing to support legal foreign residents being allowed to gamble in the local casinos/casino resorts but yet, his association along with himself supports discriminating against Bahamian citizens from gambling in the casinos/casino resorts in the Bahamas?

Why when recently asked by a local reporter the question about the hotels not wanting Bahamians in their hotels, the president of the Bahamas hotel association replied:

"I don't see how you can say that. Our casinos and our hotel facilities are public places. And we invite Bahamians to participate in a number of the ventures that we have — whether it's our restaurants, our bars, our entertainment facilities. The bottom line is that the law as it presently stands do not allow Bahamians to gamble in casinos."

Why would the president of the Bahamas hotel association use a scapegoat distraction to cover the fact that the response given clearly has nothing to do with the question of why Bahamians cannot gamble in the casinos/casino resorts?

Off course the law states that Bahamians cannot gamble in the casinos/casino resorts and off course Bahamians can go into the hotels restaurants, bars and entertainment facilities.

However, what does the restaurants, bars and the entertainment facilities have to do with Bahamians gambling in the casinos/casino resorts on the tables, the slot machines or in the sports book like every other nationality can?

More importantly, if the president of the Bahamas hotel association and the rest of his association are so concerned about the law stating that Bahamians are not allowed to gamble in the casinos/casino resorts, why is it that they are so focused on changing the law to allow a nationality lottery in the Bahamas and to only allow legal foreign residents to gamble in the local casinos/casino resorts but on the other hand, continue to support discrimination against me and the rest of my fellow Bahamian citizens from gambling in the casinos/casino resorts in which all of the casino resorts are in the same hotel association that he is the president off?

What about legal foreign residents that are married to Bahamian citizens?

This means that the president of the Bahamas hotel association would support Jill (a legal foreign resident) being allowed to gamble in the local casinos/casino resorts but on the other hand, he and his association would not support her husband Jack (a Bahamian citizen) being allowed to gamble in the same local casino/casino resort?

What about Jill’s children who were born in the Bahamas that is now 18 and/or over?

Why should Jill’s husband and children (who are now adults 18 years of age or older) not have the same right to play in the local casinos/casino resorts that Jill would be allowed to play in or vice versa if Jack was the legal foreign resident and Jill was a Bahamian citizen?

What kind of message is the president of the Bahamas hotel association and the rest of his association trying to preach?

Why is it that the president of the Bahamas hotel association and the rest of his association are not focused on changing the present gaming laws in the Bahamas to allow every human being the right to freely chose whether or not they want to play in the local casinos/casino resorts in the Bahamas based on their own individual actions rather than promoting persons to be automatically disqualified based on their country of origin?

It has to make you wonder if there is something more to this that if I was to type it on the internet, "......... .. ........ ...".

What’s more amazing is the fact that the non-Bahamian owner of the same casino resort that the president of the Bahamas hotel association is an employee for announced to the world on June 8th, 2009 (a few weeks later) that he on the other hand welcomes all Bahamians to play in his casino resort. He added that gaming in the Bahamas continues to be hurt by outdated laws that fail to make the jurisdiction competitive.

Not only that, what's even more amazing is the fact that on August 4th, 2009 (almost three months after the president of the Bahamas hotel association announced his support for discrimination against Bahamian citizens), the president and managing director of another casino resort in the Bahamas stated that he to would be open to the idea of locals being able to gamble at the property as there is a need for an urgent review of the regulations to make the Bahamas a more competitive gaming jurisdiction. He also stated that any new segments of potential business that could be opened up would be useful for the casinos, whether it's permanent residents or legal residents or whether it's all Bahamian citizens.

More importantly, he added that the minute table games were allowed to be installed at the Seminol* India* Casin*, the Har* Roc* Casin* in Florida, and gaming was added into all the Rac* Trac** in Florida, it certainly impacted us here in the Bahamas because people from Florida who used to come down every weekend for a little fling, now instead of every weekend maybe they'd come once every two months because it's easier to just drive from their house down the street, so we've really been impacted there. Also, he suggested that in some cases, the recommendations made by the Bahamas Hotel Association would be just enough to keep the casino the he manages operating on an even keel.

The bottom line is this, even the non-Bahamian owners of the casino resorts are open to the idea of welcoming all Bahamians to play in their own casino resorts as this would result in more revenue for the casino resorts, more jobs for Bahamians and no need for a major casino resort to close down for two months or to have their staff on reduced work days/weeks with sections of their resorts closed for weeks/months because of a lack of revenue.

It makes me wonder even more why the president of the Bahamas hotel association (who again is allegedly a Bahamian) would not want all Bahamians to have the right as all tourists that are not married to Bahamians to play in the casinos/casino resorts even though the non-Bahamian owners of the casino resorts makes it quite clear that they are both open to the idea of Bahamians gambling in their casino resorts.

Now if the president of the Bahamas hotel association feels that he cannot control himself while playing in a casino/casino resorts around tourists, then what he can do is exclude himself from the rest of the civilized Bahamians who do know how to conduct themselves accordingly as every Bahamian should have the right to do what a non-Bahamian can legally do in the Bahamas and each person should be judged based on their own individual actions rather than classing an entire nationality in a box which is in no way fair.

Unbelievable!!!!!!!!!

Firstly, the UBP, the PLP and the FNM are all equally responsible for allowing laws to exist back then and present that discriminates against their own people because none of the current political parties (the PLP and FNM) has yet to make an attempt to do anything to correct this wrong to this day in the 21st century.

For those who refuse to accept that or believe that, the proof is directly above as both the PLP and FNM made numerous amendments to the Lottery and Gaming Act between 1969 and 2001 but yet, this discriminatory law still exists in the 21st century.

Again, the above link will highlight the fact that in the Lottery and Gaming Act Chapter 387 section 50 disqualifies all Bahamians and tourists that are married to Bahamians from playing in any casino/casino resort in the Bahamas.

With that said, I will leave you with these few questions for you to think about and to ask those who directly have the power to correct this wrong against their own people what do they plan on doing about it:

1) Should you as a Bahamian have the right to play in a casino/casino resort in the Bahamas?

2) Should m* So* Kerzne*, m* Sarki* Izmirilia* or any other owner of a casino/casino resort in the Bahamas have the right to marry a Bahamian and still be allowed to play in any casino/casino resort in the Bahamas?

3) Should every tourist that marries a Bahamian or is already married to a Bahamian have the right to play in any casino/casino resort in the Bahamas?

4) Why should I have to give up my Bahamian citizenship and obtain citizenship from another country e.g. Haiti, Jamaica, Cuba, Trinidad, America, Africa etc, why must I obtain citizenship in those countries and be forced to give up my Bahamian citizenship in order to play in any casino/casino resort in my own country, the Bahamas? Why?

5) If in fact the RBPF was to conduct a so called raid at an internet cafe and do in fact arrest the Bahamians found in that business, what about the tourist that are also found in the internet cafe? Would the tourist also be arrested and charged? Is it illegal for a tourist to buy numbers in an internet café in the Bahamas?

6) If a non-Bahamian (including any of the owners of the local casinos/casino resorts e.g. m* So* Kerzne*, m* Sarki* Izmirilia* etc) if they were to open up an internet cafe and Bahamians and tourists were buying numbers in their internet cafes, would they (the non-Bahamian owners of the internet cafes) be arrested, charged, pay fines or face prison time and would all of their customers (Bahamian and tourists) be arrested, charged and have to pay fines and/or face prison time as well?

7) Can a person play in a casino/casino resort in the Bahamas if they have dual citizenship? (Bahamian citizenship and citizenship for any other country at the same time)

8) Can a tourist (who does not reside in the Bahamas) that is employed by the local casinos/casino resorts (e.g. Isl* O* Capr* Casin*, Bimin* Ba* Resor* an* Casin*, Atlanti*, Crysta* Palac*, Fou* Season* or any others), are these tourists who live in other countries who are employed by these local casinos/casino resorts, are they allowed to play in the local casino/casino resorts when they visit the Bahamas? (Even if they are not allowed to play in their own company's casino/casino resort because of their own company’s rules which is understandable, legally, are they allowed to play in any of the other local casinos/casino resorts?)

9) Why is it that when a tourist does it in the Bahamas, its right or legal, but when a Bahamian does the exact same thing in the Bahamas, its wrong or illegal?

10) Why was Si* Lnde* Pindlin* so determined to create a law to discriminate against his own people which is the ultimate form of non-empowerment? Was there an ulterior motive behind him doing so?

11) Why is the Bahamas apartheid?

12) Will the time ever come for the Bahamas to no longer be the only apartheid nation to exist in the world (excluding communist countries) and to finally become a 100% democratic country?

13) Is there any church/church leaders in the Bahamas who states over and over that are diametrically opposed to all forms of gaming in the Bahamas that requires there members to declare where their members monies for tithes and offerings come from and after discovering that those monies came from the gaming industry in the Bahamas, do those churches/church leaders refuse to accept those monies made from the gaming industry?

14) Are Bahamians allowed to cash in casino chips at the cashiers cages in the local casinos/casino resorts?

15) If the answer is yes to question 14, is there a cut off amount in the value of casino chips that a Bahamian can cash at the cashiers cages in the casinos/casino resorts?

16) How do you feel about the president of the Bahamas hotel association regarding his message of discrimination against Bahamian citizens, while on the other hand, only showing his absolute support for every other foreign born person living in the Bahamas (legal foreign residents, temporary holders of work permits etc) to play in the local casinos/casino resorts?

17) Again, since all Bahamians finally achieved the right to gamble in the casinos/casino resorts for almost two years after Majority Rule Day (between 1967-1969) along with the fact that the Hobb* Hors* Hal* Rac* closed down for good in 1978, why is it that every single person who agrees with discrimination against Bahamians state that the primary reason why Bahamians were barred from playing in the casino was because of the Hobb* Hors* Hal* Rac* Trac* even though Bahamians are automatically disqualified from casino gambling 9 years prior (1969)?

18) Can a person without citizenship in any country play in a casino/casino resort in the Bahamas?

To break it down for you, I have nothing but love for all of my Haitian brothers and sisters who have and continue to make positive contributions to the Bahamian society but I would like to use their nationality as an example for this question because of the frequent amount of times that this unfortunately occurs in the Bahamas.

As you know, if a male or female is born and raised in the Bahamas after July 10th, 1973 to parents who are not Bahamian citizens but instead, because of the fact that both of their parents were born in Haiti, in order for the child of these Haitian parents to become a Bahamian citizen, they must apply at the age of 18 and before the age of 19.

If their application to become a Bahamian citizen/resident is denied, or if they applied for Bahamian citizenship after the age of 19 which would automatically disqualify them from obtaining Bahamian citizenship, since they are not legally recognized in the Bahamas as Bahamian citizens or residents because of a denied application, are they allowed to play in any casino/casino resort in the Bahamas?

19) Why does the present Bahamian government in 2009 continue to prevent all Bahamians from proudly representing their country in their own country (the Bahamas) when the local casinos/casino resorts host the widely and internationally watched championship round poker tournaments held in our local casinos/casino resorts?

The Atlanti* Hote* an* Casin* Resor* recently hosted the Poker Stars Caribbean Adventure Championship Finale held on January 11th, 2009 and the even more popular and world renowned World Series of Poker Tournament Championship Finale which was held on January 4th, 2007 along with the fact that both of those tournaments among others will return to the Bahamas for other Championship Finales because of the tremendous success that they have in the Bahamas.

In fact, the next major poker tournament (the Sports Legends Challenge Poker Tournament) hosted by Suga* Ra* Leonar*, Tro* Aikma*, Karee* Abdu* Jabba*, Richar* Pett* and a few others which is being presented by Absolute Poker is scheduled to be held at the Atlanti* Hote* an* Casin* Resor* between September 14-17 2009.

Bahamians who participate in these and other world class poker tournaments all over the world could not even participate in the championship finales of those two previous poker tournaments and all other future international championship poker tournaments (including the upcoming Sports Legends Challenge) because these tournaments are being are held in their own country (the Bahamas).

Why does the Bahamian government continue to prevent all professional Bahamian poker players from participating and having their rightful opportunity to be crowned champion in the championship rounds of the poker tournaments held in their own country (the Bahamas) despite the fact that this would give the Bahamas even more free and priceless advertisement for future tourism?

Why?

That was a tremendous golden opportunity that was missed to obtain more free advertisement for the Bahamas when we hosted those previous two poker tournaments and many others especially if one of our talented Bahamians who would have won the championship finale in the Bahamas but its not too late, like I said above, the Sports Legends Challenge Poker Tournament is just a few months away.

20) For those of you who continue to use the issue of space as an excuse to justify discrimination, here is the reason why you are wrong.

Yes, the casinos/casino resorts would be extra full of people and not only on weekends but weeknights as well because remember now, Bahamians of Black, White, Asian, Spanish and Indian decent are people too.

Guess what else, obviously that would be a good thing because the purpose of any business is to make money and if their business if filled with paying customers with limited space, guess what else again, that’s a good problem, thus the need to expand, more jobs, more money making, no need for your casino/casino resort to place their staff on reduced work days/weeks and the list goes on and on etc.

Look at the Crysta* Palac* Resor* an* Casin* for example, that casino is practically empty, the staff there are on reduced days/weeks and they plan on closing for 2 months but if that casino where filled with not only tourists but Bahamian citizens, residents, work permit holders and tourists that are married to Bahamians as well, (because presently none of us fitting under those descriptions can fill up the casinos), why would there be a need for that casino resort to close down for 2 months if they are filled with paying customers?

I would hope that if any person where to go into business, their goal would not be to have as little customers as possible with all the space in the world not being utilized.

That just doesn’t make any sense to me and I would think that any true professional businessman/woman would not feel that way as well.

So what about you as a businessman/woman?

Is your goal to have as little amounts of paying customers and make as little money/profits as possible or the opposite?

21) After reading the information above, this question goes to everyone who is opposed to all forms/types of gambling:

Would you 100% fully support the Government if they were to:

a) Shut down all of the over and under/craps tables presently available at the Carnival which comes to the Bahamas every December/January? (Yes/No)

b) Discontinue allowing all businesses located in the Bahamas the right to conduct scratch and win giveaways? (Yes/No)

c) Discontinue allowing the Church/Civic Organizations/schools/local businesses the right to conduct Raffles and/or Bingo? (Yes/No)

d) Discontinue allowing all Bahamians to participate in the local/foreign stock markets?

*side note: This comment is to any and every person who would disagree with the local/foreign stock market being referred to as a game of chance/gambling and who also feels that the stock market should not be on this list. There are two words that will prove that you are taking a chance anytime you invest your money in the stock market and these two particular words were made even more popular because of a well known female celebrity "Ms Marth* Stewar*" who was recently found guilty and sentenced to prison for "CHEATING" AKA “INSIDER TRADING”. If the stock market was not based on chance, why the need for “INSIDER TRADING” to exist? So again, with that said, what is your answer. (Yes/No)

e) Shut down every single casino/casino resort in the Bahamas? (Yes/No)

f) Prevent every internet gaming website from being accessible at all locations in the Bahamas including the local casino/casino resorts and every other local business that are presently licensed by the government to allow their customers the right to access any gaming website on the internet? (Yes/No)

If your answer is “YES” to all of the above questions, then that proves that you are 100% against all forms of “GAMES OF CHANCE/GAMBLING”, and that’s fine and that is your right.

However, if your answer is “NO” to any of the above questions but yet, you claim that you are opposed to all “GAMES OF CHANCE/GAMBLING”, what does that make you?

22) I am an adult Bahamian and proud.

I am not an uncivilized savage Bahamian who is unable to control myself and more importantly, I know how to budget and spend my money.

Why should I be punished for other persons who prejudge other Bahamians that supposedly cannot control themselves and their money if that does not apply to me?

23) What about you, are you an uncivilized savage Bahamian over 18 years old who cannot control your spending and your behavior around tourists in a casino resort?

24) Why in this day and age in the 21st century do we still have to fight for an end to discrimination as those days are supposed to be long gone, and worst of all, why do some Bahamians support discrimination against them self and their entire Nationality?
