Roberts: Did the FNM abuse the nolle prosequi with corrupt pay for play scheme?

I would be remiss if I did not remind the Bahamian people of the FNM’s wanton abuse of the nolle prosequi while in office.

Serial loser Dr. Duane Sands was in the media recently talking about integrity in public life, but where was Dr. Sands when his uncle in his role as the Attorney General issued a nolle prosequi in the premeditated, cold-blooded and calculated murder of a young black male at the hands of a member of the Mosko family. The assailant fled into exile in Greece to escape justice only to return to The Bahamas to have a FNM government assist him in escaping justice with the issue of a nolli prosequi. Why else would he return? What did the FNM receive in exchange for issuing the nolle prosequi? The Mosko family is widely believed to be a financial donor of the FNM so did the FNM receive contributions from this family while this case was before the courts? How was the public interest served by denying the family of the deceased justice?


The smoking gun in this glaring and corrupt abuse and misuse of the constitution is indisputable in this apparent pay for play scheme! The FNM has never been able to answer these questions and has never denied any of the accusations of favouritism and corrupt abuse of power, contrary to the tenor, intent, spirit and letter of the supreme law!

Equally as egregious was the decision of former FNM Attorney General John Delaney in the issue of a nolle prosequi in the private prosecution of Louis Bacon by Peter Nygard. Again, how was the public interest served and the integrity of the judicial process protected by this discontinuation? Where was Loretta Butler-Turner while this decision was made? Was she fast asleep at the cabinet table since the FNM obviously believes that a nolli prosequi should firstly be discussed around the cabinet table, contrary to the constitution?

Butler-Turner physically assaulted and battered Dr. Andre Rollins but did not think she should have been held accountable for her criminal felony, but believes the Sandals Manager should be criminally prosecuted for not negotiating with and for how he spoke to employees. Loretta must explain this warped and perverted moral equivalence.

This decision appears to be another pay for play scheme on the face of it. The FNM is openly hostile toward Peter Nygard and fully in bed with Save the Bays, Mr. Bacon’s pet project in The Bahamas. Was the FNM just taking care of friends, family and lovers as they love to claim? So beholden is the FNM to Louis Bacon that the entire FNM Parliamentary caucus willing gave up their constitutional parliamentary powers, privileges and independence ostensibly to avoid offending one single strand of hair on Louis Bacon’s head. Who needs the constitution when the FNM has a foreign billionaire to please?

The FNM lacks the moral authority to fix their mouth to talk about integrity in governance or point any finger in this regard. The evidence of their corrupt abuse of the constitution over and repeatedly is compelling.

For the PLP’s part, the substantive civil proceedings in the Supreme Court adequately address the pressing issues of the union. – The issues of unfair dismissal at Sandals and the legal standing of the BHMAWU to negotiate an industrial agreement. A private criminal prosecution was unnecessary and an abuse of the judicial process. Further, the nolli prosequi does not prevent further negotiations on a labour deal.

The Attorney General and the Labour Minister stand ready and willing to facilitate an industrial agreement in the best interest of the Sandals employees.
